Contracts, big or small, oral or in writing, form the basis of most legal relationships in everyday life. An everyday challenge for us attorneys are where parties seek to enforce an agreement, only to find that the opposing party is able to exploit certain defects in a contract such as that it can have multiple interpretations or that some of the terms were not reduced to writing. This leads to lengthy, expensive and unnecessary litigation.
It is an art to draft a contract that is to the point, unambiguous and easy to understand by any person having to peruse it.
In the normal course, an application to court can take several months to finalise, however the Court, in very specific circumstances and upon meeting strict requirements, can deviate from the normal rules relating to time periods and manners of service and order the matter to be heard as on urgent basis, which can be heard as soon as the same day on which the application is issued.
Deviation form the rules are however reserved for those circumstances where a persons rights will be adversely affected if not for the urgent intervention of a Court, examples are lockouts or a parent intending to flee the Republic with a minor child without the consent of the other parent.

Eviction services are aimed at landlords, property investors or other persons with right or title in and to property who spend many resources on a property with the hope of generating a rental income from such property only to find that the tenant fails to pay rent and further fails or refuse to vacate the property.
We ensure that the strict requirements for an eviction as set out in the Prevention of Illegal Eviction and Unlawful Occupation of Land Act are met and that an order for the ejectment of the unlawful occupant is obtained as soon as possible.
In many circumstances companies are faced with an employee who requires to be disciplined or even dismissed on the basis of either misconduct or incapacity to perform duties. Once the employee was dismissed, the employer receives a notice to attend conciliation/arbitration proceedings at the CCMA and having to pay an employee compensation.

There are several procedures available to a party aggrieved by a breach of contract, which ranges from alternative dispute resolution mechanisms such as mediation or arbitration and includes your most formal dispute resolution mechanism, being litigation before a Court of law.
